PICKUP PLAY – EULA TERMS OF USE
Effective Date: April 14, 2025
1. Acceptance of Terms
By downloading, installing, or using Pickup Play (“App”), you (“User”) confirm that you have read, understood, and agree to be bound by this End-User License Agreement and Terms of Use (“Agreement”). If you do not accept every term, do not access or use the App.
2. License Grant
Subject to continuous compliance with this Agreement, Kinesthete, LLC, dba Pickup Play (“Developer,” “we,” “our,” or “us”) grants you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purposes on devices you own or control.
3. Zero-Tolerance Policy on Objectionable Content & Abuse

No Tolerance. Objectionable content—including but not limited to hate speech, harassment, threats, pornography, graphic violence, illegal activity, or any content reasonably deemed offensive— is strictly prohibited.

Abusive Users. Any user engaging in harassment, discrimination, doxxing, or other abusive behavior will be ejected from the App without notice.

Developer’s Right to Act. We may remove or disable access to any content or user account that violates this Agreement at our sole discretion.
4. Filtering of Objectionable Content
We employ automated and human-reviewed filters that scan user-generated content (UGC) for keywords, images, and behavioral patterns commonly associated with objectionable material. These filters operate before and after content is posted. Filtered items are quarantined pending manual review.
5. User Reporting & Flagging Mechanism

Flagging. Every post, message, profile, and media item contains a “Report” or “Flag” button.

Reporting Categories. Users can select predefined categories (e.g., “Harassment,” “Graphic Violence,” “Spam,” etc.) and optionally add comments or evidence (screenshots, links).

Confirmation. Reporters receive confirmation that the report was submitted and will be reviewed within 24 hours.
6. Blocking Abusive Users
Users may block any other user at any time by selecting “Block User” in the profile menu. Blocking prevents:

Direct messages

Content visibility (posts/comments)

Push or email notifications originating from the blocked user
7. Developer Response & Enforcement

24-Hour Response Window. We review all objectionable-content reports within 24 hours of receipt.

Actions Taken. If a report is verified:

The offending content is removed.

The offending user account is permanently or temporarily suspended (“ejected”).

Notice. Where feasible, the offending user receives a brief explanation of the violation; serious or repeated offenses may result in immediate permanent ban without prior notice.

Recordkeeping. We maintain a log of reports and enforcement actions for at least 12 months.
8. User Obligations
You agree to:

Provide true, accurate information.

Comply with all applicable laws and this Agreement.

Refrain from reverse-engineering, decompiling, or exploiting the App.

Bear sole responsibility for any content you submit.
9. Termination
We may suspend or terminate your license and access at any time for breach of this Agreement. You may terminate by deleting the App and all copies. Sections 3, 7, 10–12 survive termination.
10. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
IN NO EVENT WILL DEVELOPER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR AGGREGATE LIABILITY EXCEEDING FIFTY U.S. DOLLARS (US $50), ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE APP.
12. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of Colorado, excluding conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Boulder, CO, and you consent to personal jurisdiction therein.
13. Modifications
We may modify this Agreement by posting an updated version in-App or on our website. Continued use after the effective date constitutes acceptance of the revised terms.
