PICKUP PLAY – PRIVACY POLICY

Kinesthete, LLC (“Pickup Play,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Pickup Play App or visit our website (collectively, the “Services”).

3. HOW WE USE YOUR INFORMATION
We process your information to:

Provide the Services. Operate, maintain, and improve the App; create and manage accounts; facilitate Games, chats, and invitations.
Personalize & Match. Recommend nearby Games and Players based on location and preferences.
Process Transactions. Facilitate in‑app purchases and subscriptions via the Stores.
Communicate. Send transactional notices (e.g., Game updates, security alerts) and, where permitted, marketing communications.
Analytics & Development. Monitor usage, diagnose problems, conduct research, and develop new features.
Legal Compliance. Detect, investigate, and prevent fraud, abuse, and violations of our Terms; comply with legal obligations.
Consent‑Based Uses. Any other purpose disclosed to you and to which you consent.

4. LEGAL BASES FOR PROCESSING (EEA/UK ONLY)
Where the EU or UK General Data Protection Regulation applies, our legal bases include: (a) contract performance; (b) legitimate interests (e.g., providing and improving the Services); (c) your consent (e.g., marketing, precise location); and (d) compliance with legal obligations.

5. DISCLOSURE OF INFORMATION
We may share information:

With Other Players. Profile information, Game listings, and chat messages you choose to share will be visible to other Players.
Service Providers. Hosting, analytics, payment processors, customer support, and other vendors who process data on our behalf and under confidentiality agreements.
Legal & Safety. Where required by law or to protect rights, safety, or property of Pickup Play, Players, or the public.
Business Transfers. As part of any merger, acquisition, asset sale, or financing, subject to standard confidentiality obligations.
With Consent. Otherwise with your explicit consent.
We do not sell or “share” personal information for cross‑context behavioral advertising as those terms are defined under California law.

6. COOKIES & ANALYTICS
We and our third‑party analytics partners (e.g., Google Analytics for Firebase) use mobile SDKs and similar technologies to collect Usage Data. You can opt out of certain analytics in your device settings or by following platform‑specific opt‑out instructions.

7. DATA RETENTION
We retain personal information:

Guest Data: Until the App is deleted or for up to 30 days of inactivity.
Registered Accounts: For as long as your account is active and for seven (7) years thereafter (or longer if required by law) for legal, tax, and audit purposes.
Chat Messages & Game Listings: Until deleted by you or for up to 90 days after account closure, unless retention is necessary for dispute resolution or legal compliance.

8. SECURITY
We implement administrative, technical, and physical safeguards (including encryption in transit, access controls, and regular security reviews) to protect your information. No system is 100% secure; you use the Services at your own risk.

9. YOUR PRIVACY RIGHTS
Depending on your jurisdiction, you may have the right to:

Do Not Sell or Share (CA)   We do not sell/share data, but you may still submit a request for confirmation.
We will verify your identity before fulfilling certain requests. Authorized agents may submit requests on your behalf where permitted by law.

10. CHILDREN’S PRIVACY
The Services are not directed to children under 13  (or under 16 in the EEA/UK). We do not knowingly collect personal information from children. If we learn that we have inadvertently collected such data, we will delete it promptly.

11. INTERNATIONAL TRANSFERS
We are based in the United States. Your information may be transferred to, stored, and processed in the U.S. and other countries that may not provide the same level of data protection. Where required, we rely on Standard Contractual Clauses or equivalent safeguards.

12. DO NOT TRACK & GLOBAL PRIVACY CONTROL
The App does not respond to browser “Do Not Track” signals. Where legally required, we honor Global Privacy Control (“GPC”) signals for web‑based portions of the Services.

13. CHANGES TO THIS PRIVACY POLICY
We may update this Policy from time to time. If we make material changes, we will notify you via the App or by email and update the “Effective Date” above. Continued use after the effective date constitutes acceptance.
